These Repair Service Terms apply to every repair, upgrade or warranty request submitted to Casey's Custom Cockers / 3C Paintball ("3C", "we", "us"), whether mailed in or dropped off. By checking the box on the repair request form, you ("you", "the customer") agree to these terms.
1. One Marker Per Request
Each request covers one marker and receives its own RMA number, shipping label and invoice.
2. Shipping Labels And The Ship-By Date
- For mail-in requests we email you a prepaid UPS label and a packing slip. Your confirmation email and packing slip show a ship-by date.
- If the label has not been scanned by UPS by the ship-by date, the label is cancelled. We will email you that the label has been cancelled. A cancelled label must not be used. Shipping with a cancelled label is not permitted; if a cancelled label is used anyway, you are responsible for all resulting shipping charges.
- If your label is cancelled, your request is closed. You may submit a new request at any time.
3. Declared Value And Insurance
- You must declare the accurate value of your marker. We insure the shipment to us and the return shipment to you for the value you declare.
- You are responsible for the accuracy of the declared value. Any insurance claim is limited to the declared value and to the terms of the shipping insurance provider.
4. Shipping And Insurance Charges
- Inbound shipping, return shipping and shipping insurance (both ways) are charged to you and added to your repair invoice. No payment is taken when you submit a request.
- Shipping and insurance charges include a handling fee.
5. Check-In And Pre-Existing Condition
- When your marker arrives we inspect it and document its condition with notes, photos and/or video, which you can see in your account.
- We are not responsible for pre-existing damage, wear, defects or missing parts, whether or not you listed them on your request.
6. Estimates And Approval
- No work begins without an estimate that you have approved. We will send you an estimate to approve or decline by email and in your account.
- If additional work or cost is needed later, we may ask you to approve the change.
7. Declined Or Unapproved Estimates
- If you decline the estimate, or do not approve it, you are still responsible for inbound shipping, shipping insurance and return shipping (including return insurance).
- We will send you a return invoice for those charges. Your marker ships back only after the return invoice is paid.
8. Payment
- When work is complete we send a final invoice that includes the approved work, parts, shipping and insurance. Your marker ships back after the invoice is paid.
- We hold a lien on your marker for all unpaid charges and may keep it until they are paid.
9. Unpaid Or Unclaimed Repairs (Abandonment)
- The final or return invoice is due when sent. While it is unpaid we will send payment reminders by email (currently every 7 days), with clear notice as the deadline approaches.
- If an invoice remains unpaid 90 days after it was sent, or a paid repair is not picked up within 90 days, the marker may be considered abandoned and may be sold or otherwise disposed of to recover the amount owed.
- Before any sale or disposal, we will send you written notice by certified mail to the address on file, at least 15 days in advance, stating the proposed manner, time and date of the disposition or sale. You may reclaim your marker by paying the amount owed (or picking it up) before that date.
- If the marker is sold, the proceeds are applied to the amount owed and the reasonable costs of the sale, and any remaining balance will be returned to you.
10. Warranty
- We warrant the work we performed for 90 days from the date your marker ships back to you (or is picked up).
- The warranty covers only the work we performed. It does not cover other parts of the marker, pre-existing issues, normal wear, or damage from misuse, accidents, improper maintenance or modifications by others.
- To make a warranty claim, use the Request Warranty Service button in your account. We decide on the estimate whether the work is covered; covered labor and parts are $0. Whether shipping is covered on a warranty claim is decided case by case.
11. Limitation Of Liability
- To the fullest extent permitted by law, our total liability for any loss of or damage to your marker, for any reason (including while it is in our care, during repair or in shipping), is limited to the declared value you provided on your request.
12. International Repairs (Canada, United Kingdom And Australia)
- We accept mail-in repairs from Canada, the United Kingdom and Australia. Your prepaid UPS label includes a customs declaration describing your marker as customer-owned property sent to us for repair and return, at the value you declare and the country of manufacture you give us. You are responsible for that information being accurate. The customs form for the return shipment lists your marker and the repair charge.
- All charges are in US dollars.
- Import duties, taxes and customs or brokerage fees charged by your country when your marker is returned to you are your responsibility. Any duties, taxes or brokerage fees we are charged when your marker arrives in the US will be added to your invoice.
- Customs inspections and delays are outside our control. The ship-by date and our turnaround times don't include time spent in customs.
- Send only the marker. Do not send air or CO2 tanks, gas, paint or batteries. You are responsible for following your country's laws on exporting, importing and owning paintball markers.
- Australia: paintball markers are treated as firearms. You must get any police certification or permit needed to bring your marker back into Australia (including form B709A from your state or territory firearms registry) and any permission needed to send it out. If customs holds, refuses or returns your marker for lack of a permit, any extra shipping, storage or customs charges are your responsibility.
- Notices under section 9 (Abandonment) will be sent by international registered or tracked mail to the address on file.
13. Changes To These Terms
We may update these terms. The version you accepted is recorded with your request and applies to that request.
